TERMS OF USE

"TELMA OFFICIAL" (hereinafter referred to as the "Website") is a website operated and managed by BBF, Inc. (hereinafter referred to as "BBF") under commission from TELMA Corporation (hereinafter referred to as "TELMA").

The sales of TELMA's products on the Website are conducted by BBF, TELMA's authorized distributor for e-commerce.

When using the Website (including visiting, browsing, purchasing products, or otherwise using the services of the Website), you are deemed to have agreed to these Terms of Use and the various terms and conditions posted on the Website (including, but not limited to, the indication under the Specified Commercial Transactions Act and the Privacy Policy).

When using the Website, please review these Terms of Use and the above terms and conditions in advance.

These Terms of Use (hereinafter referred to as the "Terms") shall apply to all persons who visit, browse, or purchase products through the Website or otherwise use the services provided on the Website (hereinafter referred to as "Users"), as well as Users who are registered as members of the Website (hereinafter referred to as "Members," and Members shall be included in the definition of Users), and shall apply to all matters associated with the use of the services provided by BBF on the Website.

1. BBF may, at its discretion, change all or part of these Terms without obtaining the User's prior consent, in accordance with the following provisions:
   1. When the change to these Terms conforms to the general interests of the Users.
   2. When the change to these Terms does not conflict with the purpose of use of the Website and is reasonable in light of the necessity of the change, the appropriateness of the contents after the change, whether or not these Terms contain a provision stating that such changes may be made pursuant to this Article, and other circumstances relating to the change.
2. When making changes to these Terms pursuant to the preceding paragraph, BBF shall establish the effective date of the revised Terms and notify Users of the fact that the Terms have been changed, the contents of the revised Terms, and the effective date by posting such information on the Website.
3. If a User uses the Website after the revised Terms have become effective, the User shall be deemed to have agreed to the revised Terms.

In principle, the Website operates 24 hours a day, 365 days a year; however, the services may be temporarily suspended without prior notice for maintenance or other reasons.

1. In addition to changes to these Terms, BBF may, when deemed necessary, notify Users of necessary matters from time to time by displaying such information on the Website.
2. The notices set forth in the preceding paragraph shall be deemed to have been given to all Users at the time they are displayed on the Website.

1. BBF shall, in principle, provide information regarding the services provided to Users, administrative communications relating to the operation of such services, announcements and advertisements regarding new services, and other information by electronic means. However, if a User has indicated or registered, either before or after such provision, in the manner prescribed by BBF, that the User does not wish to receive such information, BBF shall not use electronic means to provide or distribute such information unless there are special circumstances.
2. The User shall assume all responsibility for any information that the User personally sends to a third party through the Website and shall not cause any inconvenience or damage to BBF.
3. In the event that a User causes damage to another User, a third party, or a rights holder, or a dispute arises in connection with the use of the services, the User shall resolve such matter at the User's own expense and responsibility and shall not cause any inconvenience, impact, or damage to BBF.
4. If the User is a minor, the User must obtain the approval and consent of a person with parental authority when purchasing products.

1. Membership registration shall be completed when the User who wishes to register as a Member submits an application in accordance with the procedures prescribed in the application form on the Website and BBF approves such application.
2. An application for membership registration must be made by the User who wishes to register as a Member, and no person other than the User concerned, including an agent, may submit such application.
3. BBF shall not approve an application for membership registration if any of the following applies. Please note that:
   1. The applicant has made a false statement.
   2. The applicant has previously engaged in any of the prohibited acts set forth in Article 10, BBF determines that there is a possibility that the applicant may engage in any such prohibited act, or BBF determines that such prohibited act may cause inconvenience or harm to other Users.
   3. BBF otherwise determines that the applicant is inappropriate as a Member in light of generally accepted social standards and applicable laws and regulations.
4. Users who register as Members shall be limited to persons who have an address in Japan.
5. A User who registers as a Member shall be deemed to have warranted to BBF that the User is 18 years of age or older, or, if the User is under 18 years of age, that the User has obtained the consent of a parent or guardian to receive BBF's services, including entering into a sales contract for products.
6. A User who registers as a Member shall manage and retain, at the User's own responsibility, the email address and password established upon completion of membership registration.
7. If there is any change to the User's name, address, telephone number, email address, or any other information registered on the Website (hereinafter referred to as the "Registration Information"), the Member shall promptly update such information. If BBF suffers any damage due to a delay in updating the Registration Information, the Member shall compensate BBF for such damage.

A Member shall not assign to or allow a third party to use any right to use the Website as a Member, any right granted to a User, or any other right against BBF, nor shall a Member provide any such right as security to a third party.

BBF shall appropriately manage personal information received from Users in compliance with applicable laws and regulations in accordance with the separately established Privacy Policy. In addition, BBF shall provide the personal information received from Users to TELMA, the manufacturer of the products. TELMA shall appropriately manage such personal information in compliance with applicable laws and regulations in accordance with the Privacy Policy established by TELMA. Users must agree to the provisions of this Article in order to receive services and purchase products. Please note that if a User does not agree to the provisions of this Article, the User may not be able to use all or part of the services, such as purchasing products.

1. If the information provided by a User falls under any of the following items, BBF may, at its discretion, temporarily suspend or delete the User's membership registration without prior notice. In this case, BBF shall have no obligation to disclose the reasons for such suspension or deletion:
   1. When the information provided by the User falls under the prohibited items listed in Article 10.
   2. When promotional materials sent based on the information provided by the User (including cases sent via email, etc.) cannot be delivered due to non-delivery.
   3. In addition, when BBF determines that the User's registration is inappropriate or unnecessary for any reason.
2. BBF will implement necessary and appropriate security measures for the information registered and provided on the Website by Users. However, BBF shall not be held responsible for the loss or deletion of such information due to force majeure or other reasons not attributable to BBF.

1. Users shall not engage in any of the following acts when using the Website:
   1. Using the information, copyrighted works, etc., provided on the Website for purposes other than personal use, re-providing them to the public inside or outside the network, or infringing upon the copyrights of BBF, TELMA or any third party.
   2. Registering or providing false information through or in connection with the Website.
   3. Defaming, slandering, or damaging the reputation of BBF, TELMA or a third party.
   4. Infringing upon the property or privacy of BBF, TELMA or a third party.
   5. Transmitting or writing harmful computer programs, etc., to BBF, TELMA or a third party.
   6. Violating laws and regulations.
   7. Election campaigning or similar acts.
   8. Disclosing information, documents, figures, etc., that are contrary to public order and morality through the Website.
   9. Engaging in acts that violate the rules of domestic or international networks when communicating via such networks.
   10. Using the Website for commercial purposes.
   11. Any other acts that interfere with the operation of the Website for any reason, or acts that BBF or TELMA deems inappropriate.
2. If BBF or TELMA suffers any damage arising from a User's breach of the prohibited acts set forth in the preceding paragraph, the User shall be liable to compensate BBF or TELMA for such damage.

1. Users may purchase products using the services on the Website.
2. Users who wish to purchase products shall do so in accordance with the ordering procedures designated on the Website.
   ■Establishment of Order and Sales Contract
3. When a User places an order for products on the Website, BBF will send an email containing the order details in the name of the Website (hereinafter referred to as the "Order Completion Email") to the User. A sales contract for the products shall be established between the User and BBF at the time the Order Completion Email reaches the User. Even if a sales contract has been established, if there are doubts or unclear points during email exchanges that raise questions about the contents of the sales contract, BBF Support Center may contact the User by telephone or other means to confirm the order. In such cases, the details of the sales contract shall be finally determined in accordance with the confirmed contents upon completion of the confirmation. If there is any defect or discrepancy in the established sales contract (e.g., an incorrect price displayed by BBF), BBF may cancel the contract after consultation with the User. Please understand this in advance.
4. When placing an order, please pay attention to the matters set forth in the following items.
   ■Precautions for Ordering
   1. In the event that the correct sales price of a product differs from the price displayed on the Website, BBF may (a) notify the User prior to shipping, ask the User to confirm the correct sales price, and receive instructions for shipment, or (b) if the User does not wish to purchase the product at the correct price (including cases where no shipment instruction is received after confirming the correct price), BBF may cancel the order.
   2. Please note that the colors, etc., of product images may differ slightly from the actual product depending on your monitor settings.
   3. Product sizes may vary depending on the fabric, design, and characteristics of the product or brand.
   4. If a single order includes unreleased new products (pre-orders, etc.) or made-to-order products, all products will be shipped together according to the release date of the new product or shipment date of the made-to-order product.
   5. If you wish to receive individual shipments, please order new products, made-to-order products, and other products separately. Orders placed together cannot be separated into individual shipments after the order is placed.
      Shipping fees will apply per order.
   6. Products ordered separately on the same day or different days cannot be combined into a single shipment or substituted.
   7. If you select cash on delivery (e-Collect), a separate cash-on-delivery fee will apply. The maximum limit for cash on delivery is 500,000 yen (tax included) per order. If the total amount exceeds 500,000 yen (tax included), please place multiple separate orders within 500,000 yen (tax included) each.
   8. In the case of pre-orders, if the number of reservations exceeds the available stock and the product cannot be secured for the User on the release date, or if the product is discontinued or out of stock, the product may not be provided. In such cases, BBF will cancel part or all of the reservation and notify the User accordingly.
   9. If products are returned to BBF's warehouse due to long-term absence or other reasons for non-receipt by the User, the sales contract between the User and BBF shall be terminated without any further procedure, and the purchase price shall be refunded or the credit card payment shall be cancelled, as applicable. In this case, ownership of the products shall revert through BBF and ultimately to TELMA.
5. Ownership of all products purchased on the Website shall be transferred to the User at the time the products are handed over to the User by BBF's designated delivery company (the method of delivery shall conform to the rules of each delivery company). If a product is lost prior to arrival at the designated delivery address due to intentional misconduct or negligence of the delivery company, TELMA shall, in principle, be responsible for such loss. However, even if BBF receives notification from the User that the product has not been received, TELMA may not assume responsibility after careful investigation if there is a record in the data processing systems of TELMA, the delivery company, or other relevant parties showing that the product was shipped to and handed over to the User.

1. Payment methods for purchasing products on the Website shall be e-Collect (cash on delivery), credit cards in the name of the User, Amazon Pay, and Paidy. In the case of credit card payment, the User shall comply with the terms separately contracted between the User and the credit card company.
2. If any dispute arises between the User and a credit card company, payment agency, or other third party regarding charges or other liabilities related to payments on the Website, it shall be resolved between the User and the relevant party.

Shipping fees for products purchased on the Website shall be borne by the User, except in cases of various campaigns, etc.

1. The payment amount and payment method for purchasing products and services shall conform to the order form and usage guide for each product.
2. If the User pays by credit card, the User shall comply with the terms of the contract with the credit card company. If any dispute arises between the User and the credit card company, it shall be resolved between the parties, and the Website assumes no responsibility.

1. Upon arrival of your ordered products, please open the package within seven (7) days and inspect the items and delivery slip. In the event of an initial defect, we will promptly provide a refund. Please review the following rules, fill out the form or email with the required information, and submit it to us. TELMA shall bear the shipping fee for returning initial defective items. In the case of an initial defect, please Contact Us within seven (7) days of arrival. However, please note that we cannot accept returns or exchanges even if you contact us within seven (7) days of arrival if any of the following applies:
   ■Non-Returnable / Non-Exchangeable Items
   1. Any item enclosed with the product upon delivery, such as a delivery slip, catalog, shipping notice, or product tag, is missing.
   2. Products that have been worn or used, or products that have been damaged or soiled while in the User's possession.
   3. Returns based on the User's personal convenience (e.g., the size does not fit, the actual color differs from the image, the User ordered the wrong item, etc.).
   4. Underwear, tights, socks, stockings, and other such items (cannot be returned or exchanged for hygienic reasons).
   5. Products for which the User has requested name placement or special specifications.
2. In addition to the above items, even if BBF or TELMA objectively determines that a return or exchange is inappropriate under generally accepted social standards, exchanges shall be accepted only for initially defective items and only for the same item. Replacement with a different product is not accepted. If you wish to exchange an item for a different product (including a different color or size), please return the initially defective item and place a new order for the desired product.
3. Once a request for a return has been submitted, it cannot be changed to an exchange request.
4. If products are returned to BBF or TELMA without prior notification, regardless of whether they are defective or non-defective, used or unused, no action will be taken. In such cases, the returned products will be disposed of.
5. If the replacement item is out of stock, we will arrange for it as soon as possible; however, delivery may be delayed beyond your requested exchange date.
6. Stock checks for replacement requests will be conducted after receiving the request. If items cannot be prepared due to being sold out, discontinued, or for other reasons, we will process a return and refund (we will notify you by email after checking the stock).
7. After the sales contract is established, orders cannot be canceled due to the User's personal convenience unless there are special circumstances.
8. All inquiries regarding returns and exchanges must be made by email through the inquiry page provided on the Website. As the Website is an Internet-only store, inquiries and requests for returns or exchanges cannot be handled by telephone or FAX.

1. BBF may cancel the sales contract with a User even after the Order Completion Email has been received by the User if any of the following applies:
   1. When items with a long-term undetermined restock date or discontinued items are ordered (including cases where such situations arise after ordering).
   2. When an order exceeds the purchase quantity limit for limited-quantity items.
   3. When an order is placed for an item that is out of stock.
   4. When the User fails to receive the items and gives no response within a reasonable period (approximately seven (7) days from the initial delivery attempt, depending on the carrier's storage policy) despite notices or reminders from BBF or the delivery carrier, or fails to respond to phone calls from BBF.
   5. When there is a significant error in the displayed product price.
   6. When false information is found in the User's personal information.
   7. When the User violates any of the prohibited acts specified in Article 10.
   8. In addition to the above, when BBF reasonably deems cancellation appropriate based on generally accepted social standards.
2. If BBF cancels the sales contract pursuant to the preceding paragraph, BBF will refund the paid amount using the method specified in Article 17. BBF shall not be liable for interest on the refunded amount or for damages related to such cancellation.

1. Refunds from BBF to Users shall be processed via one of the following methods. Refunds via registered cash mail or other methods are not accepted:
   1. Canceling the charge or adjusting the billed amount through the respective payment service.
   2. If the above method cannot be used, transferring the refund amount to a bank account designated by the User.
2. Depending on the method of receiving the refund, the User may need to take certain actions to receive the refund. If BBF completes preparation for the refund and notifies the User, but the User fails to receive the refund, BBF's obligation to refund shall expire by prescription one (1) year from the date of dispatch of the final notice. In principle, BBF does not issue refunds by bank transfer; however, if the User requests such a transfer and BBF determines that there are unavoidable special circumstances, BBF may transfer the refund directly to an account held in the User's own name. In such cases, if the refund cannot be made due to an error in the account number or other information provided by the User, BBF will notify the User again. If the User fails to respond, BBF's obligation to refund shall expire by prescription one (1) year from the date of dispatch of the final notice.
3. In addition to product returns, if (i) BBF receives an excess payment from the User due to an error in the displayed product price, or (ii) it becomes impossible for BBF to deliver the product to the User due to a shortage of stock or other special circumstances, BBF shall refund part of the payment (the excess amount received in case (i)) or the entire payment (in case (ii)). In such cases, BBF will complete preparation for the refund and notify the User; however, if the User does not respond at all, BBF's obligation to refund shall expire by prescription five (5) years from the date of dispatch of the final notice.
4. Refund procedures will commence after TELMA confirms that the returned products have arrived at the logistics center.
5. Due to the business days of financial institutions and other circumstances, refunds may take seven (7) days or longer.
6. If all items in an order are returned due to initial defects, the full transaction amount, including shipping and handling fees, will be refunded. If only part of a multi-item order is returned due to defects, shipping and handling fees will not be refunded.
7. This Article and the preceding Article constitute the entire extent of BBF's obligations and liabilities with respect to products purchased on the Website. Unless otherwise provided in these Terms, BBF shall have no other liability with respect to the exchange or repair of products.

BBF may delete content transmitted (posted) through the Website or change its location if BBF deems it necessary with respect to information posted on the Website. BBF's right to delete includes the right to remove content that violates these Terms or content deemed problematic for the Website.

1. BBF may modify the contents of the Website or temporarily suspend or discontinue all or part of the Website services without prior notice to Users in any of the following cases:
   1. When performing periodic or emergency maintenance on the Website, or due to unavoidable construction needs.
   2. When a telecommunications carrier suspends or terminates telecommunications services.
   3. When service provision becomes difficult due to force majeure such as natural disasters, power outages, war, or interference by third parties.
   4. In addition, when BBF determines that modification, suspension, or discontinuation is necessary for operational or technical reasons.
2. BBF may temporarily suspend or discontinue a User's access to the Website without prior notice if BBF deems it necessary.
3. BBF shall not be held liable for any damages incurred by Users resulting from modifications, temporary suspensions, or discontinuations set forth in Paragraphs 1 and 2 of this Article.

1. BBF or TELMA shall be released from liability by processing administrative duties in accordance with the registered details of Users. BBF or TELMA shall not be liable for any damage incurred by Users or third parties resulting from inaccurate registration details.
2. BBF or TELMA fulfills its notification obligations by sending notifications to the email address registered by the User in advance, and fulfills its product delivery obligations by delivering products to the destination specified by the User at the time of purchase.
3. Regardless of the legal cause of claim, BBF or TELMA shall not be liable under any circumstances for any damages, losses, or disadvantages relating to the use of services on the Website or products sold through such services beyond what is specified in these Terms.
4. BBF or TELMA shall assume no liability for any damages arising from a User's inability to use the services on the Website.
5. If a User causes damage to another User or a third party through the use of the Website, the User shall resolve the matter at their own expense and responsibility, and shall not cause any inconvenience, impact, or damage to BBF or TELMA.
6. When a Member changes their password, BBF or TELMA shall be released from liability by the Member changing the password in accordance with the procedures instructed on the Website.
7. Users shall bear all costs for computer and communication equipment required to use the Website, as well as telephone charges, LAN usage fees, application fees, and other related costs.
8. Users shall use the latest versions of Microsoft Edge, Safari, Firefox, or Chrome as their web browser when using the Website.
   BBF or TELMA assumes no responsibility and will not accept any inquiries regarding display errors or other problems caused by the use of browsers other than those specified by BBF or TELMA.
9. BBF or TELMA cannot guarantee the completeness, accuracy, certainty, or usefulness of the contents on the Website or information obtained through the Website. Furthermore, BBF or TELMA cannot guarantee that products listed on the Website are in stock, nor promise that ordered products can always be provided. All prices, specifications, release dates, etc., listed on the Website are subject to change without prior notice. BBF or TELMA assumes no liability for information listed on the Website, or for troubles, losses, or damages arising from the use of the Website. Additionally, BBF or TELMA shall not be liable to Users, regardless of the reason, cause, nature, or result of the damage, for:
   1. Any damage arising from inaccuracies, errors, or leakage of information provided on the Website, or any damage resulting from access to or failure to access the Website (including virus infections, etc.).
   2. Any damage caused by the interruption or discontinuation of Website operations.
   3. Any damage resulting from alteration of information on the Website caused by unauthorized third-party intrusion.

In the event of disputes arising from or related to a User's use of the Website, breach of these Terms or other rules, or infringement of third-party rights, such disputes shall be resolved entirely at the User's expense and responsibility. If BBF or TELMA incurs any damage (including reasonable attorney's fees) in connection with such disputes, the User shall compensate BBF or TELMA for such damage.

BBF may irregularly distribute advertisements (including third-party corporate advertisements) and banner links on the Website. Inquiries regarding such advertisements should be directed to the advertising companies. BBF shall not be liable for any damages incurred on websites linked through such advertisements. Such websites are outside the scope of support provided by the Website and shall be subject to the terms and conditions of each respective website.

1. If a dispute arises between a User and BBF, both parties shall attempt to resolve it in good faith. If resolution is difficult and litigation becomes necessary, the Tokyo District Court shall be the exclusive agreed court of first instance.
2. If an obligation to compensate for damages arises due to a User's non-payment of purchase amounts or other violation of these Terms, and BBF retains an attorney for the collection of such damages, all attorney's fees incurred in connection with such collection shall be borne by the User.

The interpretation and application of these Terms shall be governed by the laws of Japan.

All questions, requests, and opinions regarding these Terms or the Website are accepted exclusively through the inquiry page below. Please note that inquiries via telephone or FAX are not accepted.
